TEYAI SOKO TERMS OF USE

ACCEPTANCE OF THE TERMS

These Terms of Use (the “Terms”) form a legally binding agreement between Teyai Soko, its affiliated entities (collectively, “Teyai”, “we”, “us”, or “our”), and you, the user (“you”, “your”). By accessing and using the Teyai Soko website, mobile applications, and associated services and content (collectively, the “Platform” or “Service”), you agree to be bound by these Terms.

If you do not accept these Terms in full, or if you are not legally eligible to be bound by them, you must not use the Service.

Please review our [Privacy Policy] for information on how your data is handled. These Terms may be supplemented or modified from time to time, and such changes shall be effective immediately upon posting.

IMPORTANT DISCLAIMERS

All services provided via Teyai Soko are offered “as is” and “as available,” without any warranties of any kind. We do not guarantee the accuracy, quality, legality, or reliability of listings or user-provided content.

We do not control or guarantee:

  • The existence, quality, or legality of items or services listed,
  • The reliability of user information,
  • Completion of transactions, or
  • Non-infringement of third-party rights.

Users are strongly encouraged to inspect goods, verify legitimacy, and conduct all meetings in secure public places during daylight hours.

ACCOUNT REGISTRATION

Certain features require an account. By registering:

  • You confirm you are over 18 or using the Service under a guardian’s supervision.
  • You are responsible for safeguarding your credentials.
  • You agree to notify us of any suspected unauthorised access.

Teyai Soko may suspend or terminate accounts for violations including but not limited to fraud, duplication, or suspicious activity.

SERVICE

Teyai Soko provides a platform for users to post and view listings, and communicate directly. Teyai is not a buyer, seller, agent, or broker in user transactions. Users are fully responsible for:

  • Their listings and communications,
  • Tax obligations,
  • Following applicable laws.

Teyai Soko reserves the right to:

  • Remove or block listings at its discretion,
  • Modify features or access to the Platform without notice.

POSTING OF ANNOUNCEMENTS BY USERS

Users must:

  • Provide accurate and complete information,
  • Ensure reachable phone contacts,
  • Not interfere with or contradict these Terms or laws.

Content must not:

  • Mislead, infringe on rights, or promote illegal activity,
  • Contain hate speech, sexual or offensive materials,
  • Include spam, malware, or references to competing platforms.

Videos must comply with YouTube Terms or Meta Terms where applicable.

FEES

Teyai Soko offers both free and paid services. Paid options may include:

  • Promotion of listings,
  • Increased visibility,
  • Category-specific features.

Fee structures and payment terms are disclosed on the Platform. Fees are generally non-refundable.

USER REPRESENTATIONS AND WARRANTIES

You represent and warrant that:

  • You are legally permitted to use the Platform,
  • All information you provide is true and up-to-date,
  • You will not post prohibited content or items (see list),
  • You will comply with all relevant laws and respect intellectual property.

INDEMNITY

You agree to indemnify and hold harmless Teyai Soko and its affiliates against any claims arising from:

  • Your use of the Platform,
  • Your content or listings,
  • Breaches of these Terms or laws,
  • Your interactions or transactions with other users.

LIMITATION OF LIABILITY

Teyai Soko is not liable for indirect, incidental, or consequential damages arising from your use of the Platform. Our maximum liability to you is limited to the amount you have paid to us in the past 6 months or KSH 10,500, whichever is less.

INTELLECTUAL PROPERTY RIGHTS

All user-generated content remains your property, but by posting, you grant Teyai Soko a perpetual, non-exclusive, transferable license to use, display, and distribute your content for platform operation and marketing.

Teyai Soko’s content and trademarks are protected and must not be used without permission.

GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of Kenya. Disputes shall be settled by arbitration under NCIA Arbitration Rules in English.

MISCELLANEOUS

  • Invalid provisions do not affect remaining Terms.
  • We may assign our rights without your consent.
  • Failure to enforce any part of the Terms does not waive our rights.

Teyai Soko Notice for Claims of Intellectual Property Violations

Teyai Soko respects the intellectual property rights of others and expects all users of our platform to do the same. This notice outlines our policies and procedures regarding claims of copyright and trademark infringement made through the Teyai Soko website and mobile application (the "Platform").

Copyright Infringement Notification Procedure

If you are the copyright owner or an authorized agent acting on behalf of a copyright owner, and you believe that any content on Teyai Soko infringes your copyright, you may file a Copyright Infringement Notification by emailing us at: 📩 support@teyaisoko.com

Please include all of the following information in English:

  • A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  • A clear description of the copyrighted work that you claim has been infringed.
  • A detailed identification of the infringing material, including the URL or exact location of the content on the Platform.
  • Your contact information, including an email address and phone number.
  • A statement declaring: “I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law.”
  • A statement made under penalty of perjury that the information provided in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

⚠️ We advise consulting with your legal representative before submitting a claim. Knowingly submitting false claims may result in liability for damages under applicable laws.

Upon receiving a valid notice, Teyai Soko reserves the right to take appropriate action, which may include:

  • Removing or disabling access to the allegedly infringing content;
  • Notifying the user responsible for the content; and
  • Suspending or terminating access to repeat infringers.

Trademark Infringement Notification Procedure

If you are a trademark holder or an authorized agent and believe that content on our Platform infringes your trademark, you may submit a Trademark Infringement Notification to: 📩 support@teyaisoko.com

The notice must include:

  • A physical or electronic signature of the trademark owner or authorized representative.
  • A clear description of the trademark being infringed, along with:
    • Trademark name
    • Registration number
    • Applicable jurisdiction
    • List of protected goods/services
    • Trademark owner’s full name and address
  • A description of the infringing material and its location (e.g., URL).
  • Your contact information, preferably an email address.
  • A declaration: “I have a good faith belief that the use of the trademark described above is not authorized by the trademark owner, its agent, or the law.”
  • A statement made under penalty of perjury that the information provided is accurate and you are authorized to act on behalf of the trademark owner.

⚠️ Submitting a false claim may result in legal consequences. Please ensure all information is accurate and complete.

Upon receipt of a valid trademark notice, Teyai Soko may:

  • Remove or restrict access to the disputed material,
  • Notify the user responsible,
  • Terminate access for repeat violators.

Important Legal Note

Regardless of our internal actions, Teyai Soko does not waive its right to pursue legal action or remedies against infringers. We are not responsible for providing legal support or indemnity to any user accused of infringement, except where clearly stated in our policies.

Teyai Soko Billing Policy

This Billing Policy outlines how premium services and credit purchases operate on the Teyai Soko platform.

1. Premium Services

You can enhance your visibility on Teyai Soko by purchasing premium services that help boost your listings and attract more views.

2. Types of Premium Services

Teyai Soko offers a variety of promotional packages, including:

  • Boost Plans – your listing is raised above standard ones across various pages.
  • Top Ads Promo – your listing appears in a special section above regular ads for maximum visibility.

3. How to Purchase Premium Services

To access these services:

  • On the website, go to the Premium Services section or select a promotion during ad creation.
  • On the mobile app, visit the “Premium Services” tab in your profile or activate a package while posting a listing.

4. Payment Methods

You can choose from several payment methods including:

  • Mobile money (e.g., M-Pesa)
  • Debit/credit cards
  • Bank transfer or eWallets

Payment details are processed securely by third-party providers. Teyai Soko does not store full payment information. If paying in cash, you will receive bank details to complete the payment at a branch.

5. Changes to Premium Services

Teyai Soko reserves the right to modify the:

  • Types and features of premium services,
  • Pricing structure,
  • Accepted payment methods.

Such changes may be implemented at any time without prior notice.

6. Refund Policy

Due to the digital and non-tangible nature of services:

  • All purchases are non-refundable, unless required by law.
  • No refunds or credits will be provided if your listing is removed for violating our [Terms of Use], or if you voluntarily deactivate it.

7. Validity of Top Ads Promo

The Top Ads Promo package must be used within 12 months of purchase. If unused, the service expires and no refunds, exchanges, or extensions will be provided.

8. Renewals

Premium services are not subscription-based. You are responsible for manually renewing them each time they expire.

9. Disclaimer

Teyai Soko does not guarantee specific results from premium services. Performance may vary depending on multiple factors, and no liability will be accepted if expectations are not met.

10. Credits

Teyai Soko allows users to purchase Credits, which can only be used to pay for premium services. ➡️ 1 Credit = 1 Kenyan Shilling

11. Credit Validity

Credits expire 12 months from the date of purchase.

Expired credits cannot be redeemed, refunded, or extended.

12. Nature of Credits

Credits have no real-world monetary value.

They cannot be transferred, sold, or traded for cash or services except through Teyai Soko’s official mechanisms.

13. Prohibited Credit Transactions

You may not:

  • Sell or exchange credits for cash or other value outside Teyai Soko.
  • Buy or sell accounts linked to credits.

14. Forfeiture of Credits

Credits may be forfeited without notice if:

  • Your account is inactive for over 12 months.
  • You breach the [Terms of Use] or [Privacy Policy].
  • Fraud, misuse, or unlawful activity is suspected.
  • We act to protect platform users or the brand.

15. Account Closure

Unused credits will be forfeited upon account closure. No refunds or compensation will be given, regardless of whether closure is voluntary or not.

Teyai Soko Privacy Policy

This Privacy Policy explains what personal data is collected when you use Teyai Soko via its website or mobile application (together, the “Service”), and how such data will be used and shared.

BY USING THE SERVICE, YOU AGREE THAT (i) you have read, understood, and accepted this Privacy Policy, and (ii) you are over 16 years of age (or have obtained consent from a parent or guardian). You understand that by including personal data in your listings (e.g., in job ads or service requests), such data becomes publicly visible to other users.

2.2. Data from Third Parties

We may receive your data through:

  • Social login providers (Google, Apple, Facebook, Truecaller).
  • ID verification services, such as Smile Identity Inc.
  • Referral data from users who invite you.

We use this information to verify identity, enhance profile creation, and enable secure access.

2.3. Data We Collect Automatically

Includes:

  • IP address, device type, operating system, browser type, and language.
  • Usage behaviour such as page visits, time spent, features used, and transaction data.
  • Cookies, advertising IDs (IDFA or AAID), and other identifiers.

3. DATA PROTECTION PRINCIPLES

We ensure that personal data is:

  • Processed lawfully and transparently.
  • Accurate and stored securely.

8. NO LIMITATION CLAUSE

Teyai Soko will not limit its liability if found to be in breach of core data protection principles (see Section 3).

We may revise this Policy. Significant changes will be communicated via the Service. Continued use after updates indicates your acceptance.

13. DATA RETENTION

We retain your data:

  • For as long as your account is active.
  • As required by legal, regulatory, or operational needs.
  • Even after account deletion, for limited timeframes, to comply with obligations.
